Like a string of broken-down buses the Praetorian Legal and Mercantile Claims indemnity certificates take another turn down a twisted and meaningless motorway to financial peril.
We reported that a bogus indemnity policy was being peddled by both Praetorian Legal and Mercantile Claims who are two sister law firms operating in Solihull, near Birmingham. Both offer a timeshare termination service to consumers and charge many £000s for the service.
The termination letters which are sent are embarrassing at best and should these letters not effect a termination of the client's timeshare contract, both Praetorian Legal and Mercantile Claims back up their service with a prestigious and bespoke legal insurance indemnity policy which protects their clients against any legal and other costs up to £10,000. Therefore, this policy is the kingpin to thier sales operations.
The last article Praetorian Legal and Mercantile Claims (click on the link). We conducted research regarding their alleged 'Indemnity Policy'. The investigation concluded the insurance indemnity product did not exist. Accordingly, Praetorian and Mercantile clients are exposed to financial peril and unlawful practices.
Before publication of the last article, we instructed a letter to be sent to Mr Fosbery (the owner and director) of Palm Services Ltd who acted on behalf of ‘All Round Travel Services Ltd’ (ARTS) and the MGP Group. The letter explained a client had paid money for an unsuccessful termination service. In need of the protection offered in the indemnity policy they supplied, these clients wanted the policy document and a claim form. This letter was responded to by Mr Fosbery and he explained that he had fallen for smooth-talking timeshare rhetoric given by the Smiths (Directors of Praetorian Legal and Mercantile Claims) and failed to confirm if the policy existed. He did explain that on account of the Smiths' pomposity he had lost thousands and the Smiths had blatantly misused his company name and his regulated position.
Mr Fosbery describes the clients of Mercantile Claims and Praetorian Legal as victims and unfortunate vulnerable people. Therefore, from Mr Fosbery's prospective he and his companies are innocent victims of passing off and fraud.
The bedraggled policy now exposed, the Smiths were in meltdown and needed another ruse to continue selling the fake insurance policy, thus instructed ‘Soaronline’ (their marketing company) to create a website with the domain name called ‘Artsscheme.com’.
The ARTS website is on the internet and now further deludes the general public into the belief that there is a policy and consumers are protected. The All-Round Travel Service [ARTS] has been exposed so it’s now being sold as Assured Reliable Timeshare Services Ltd (ARTS).
To complete the ruse the company ‘Assured Reliable Timeshare Services Ltd’ (ARTS) was created on the 17th of June 2019 when our investigation was nearly complete. That said, the benefits of the scheme now offered are discretionary and subject to terms and conditions which are not disclosed to date. This new ARTS company has no equity, is a not for profit and is now being directed by Alexander Morrison from Unit 3 Merchant, Evegate Business Park, Ashford, Kent, England, TN25 6SX and £0 is its equity.
Doubling up, we discovered a second company has also been created on the 6th of June called Administration Resources & Timeshare Services Ltd (ARTS) again headed by Mr Morrison however, this is traded from Unit 115-119, Fort Dunlop, Fort Parkway, Birmingham, West Midlands, England, B24 9FE. The memorandums, articles of association and the amount of equity is the same in each company £0.
Noteworthy is that Praetorian Legal's head office is located in Fort Dunlop, Fort Parkway, Birmingham, West Midlands, England, B24 9FE and at present it is only Praetorian Legal and Mercantile Claims that they assist. No policy is provided by all ‘Around Travel Service Ltd’ (ARTS)
Both Assured Reliable Timeshare Services Ltd (ARTS) and Administration Resources & Timeshare Services Ltd (ARTS) has no policy and they came into existence after all the alleged policy was sold and have no money.
The website artsscheme.com was created by soaronline.co.uk and like the many other websites was created by Praetorian Legal and ‘Mercantile Claims, it too is domiciled in Panama and the owner’s identities shielded.
Despite the protection offered you can break the privacy shields and via an analysis of Inter-Domain Traffic we know the website is owned by the Smiths as it sits on the servers ns1.c59110.sgvps.net and ns2.c59110.sgvps.net which is the same server as the Smiths use on its other trading website ‘MissoldClaimsassist.com’
But like many other domain names, Praetorian Legal has created the IP address 126.96.36.199 owned by namecheap.com and protected by ‘WhoisGuard, Inc’.
The website was registered on the 13th of June and came into existence on account of very good external investigation paid for by the Timeshare Association (a non-for-profit consumer helper).
The website artsscheme.com states: -
“There is always the possibility that your timeshare resort might take action against you to recover unpaid maintenance fees. The purpose of this not-for-profit company Assured Reliable Timeshare Services Ltd is to provide you with protection in the event you are sued.
Upon becoming a beneficiary of this Discretionary Legal Benefits Scheme, you will be afforded protection in the event that your timeshare resort issues proceedings against you.
The protection afforded to you by us is unique to you. You should not disclose your unique access to this website to any other individual.
